General Terms and Conditions of Sale
1. Introduction
1.1. The sale of “Xize” branded goods (hereinafter referred to as “Goods”) through the Website https://xizetime.com (hereinafter referred to as the “Website”) is subject to the following General Terms and Conditions of Sale and as amended from time to time (hereinafter referred to as the “Terms and Conditions”).
1.2. The sale of goods through the Website is limited to customers who meet the definition of Xize (hereinafter referred to as “Customers”), i.e. natural persons whose purchases are not related to business or commercial purposes, who must be at least 18 years of age (or with the knowledge and permission of their guardians if they have not reached that age) and who agree to accept these Terms and Conditions (the guardian is the customer under these Terms and Conditions).
1.3. These Terms and Conditions expressly prohibit the resale or transfer of goods purchased on the Website for any business or commercial purpose.
1.4. Products sold on this website can only be delivered to a valid address in Europe, North America, Oceania, beyond which purchases are not supported.
1.5. The language of the contract of sale concluded through the Website is English. The English and Chinese versions of the Contract of Sale shall be equally valid, however, in the event of any inconsistency or contradiction between the two, the English version shall prevail.
1.6. These Terms and Conditions are posted on the Website for the Customer’s reference and archival purposes.
1.7. The purchase of goods is subject only to the terms and conditions published and in force on the Website at the time of the Customer’s order.
1.8. Xize reserves the right to amend and/or replace these Terms and Conditions at any time.
1.9. Any amendments and/or versions of these Terms and Conditions will be effective immediately upon posting on the Website and will be effective for subscriptions made after such effective date.
1.10. If Xize modifies or changes these Terms and Conditions, any prior version will not apply to any Subscription from the time the modified or replaced version becomes effective.
2. Commodity Spot
2.1. The Customer acknowledges that the quantity of Products offered by Xize on the Website is limited and therefore the Customer understands that at the time of ordering, Xize will need to check whether the Products are in stock.
2.2. Some products may occasionally be out of stock. In this case, Xize will promptly inform the customer by SMS, e-mail or other means and reserves the right to cancel the order (see clauses 4.5 and 6.5 for details). Xize makes no promises or warranties as to the availability of goods.
2.3. Xize reserves the right to change the products sold on the Website at any time and without notice.
3. The Purchase Process
3.1. The Customer may view each product sold on the Website through a dedicated link that may include a photographic image of the product, unit price, color, size (if applicable), as well as the estimated delivery time of the non-stock products on the Website that are clearly marked as “pre-sale” or “pre-sale products” (please refer to the actual display on the dedicated link page and subject to clause 6.5).
3.2. Unless otherwise specified and stated, in order to ensure that Xize can provide better service to customers and ensure a better supply of products, Xize limits the number of purchases per customer to a maximum of 4 pieces per product (including purchasing different sizes of the same product, etc.). Further, Xize reserves the right to change the limit on the number of items that a customer may purchase through the Site at any time.
3.3. The Products selected by the Customer shall be placed in the “Shopping Bag” section of the Website (hereinafter referred to as the “Shopping Bag”). However, Xize does not promise that the items placed in the shopping bag will not be retained and can be purchased by other customers.
3.4. Information about the Products will be displayed in the Customer’s shopping bag, including quantity, color, size (if applicable), pictures of the Products displayed, etc., which shall be subject to the actual display on the pages of the Website.
3.5. Although Xize has taken reasonable steps to ensure that the images displayed on the Website reflect as accurately as possible the true condition and appearance of the Products, there may be some differences between the images and the actual product due to factors such as the technical characteristics of the equipment used by the Customer and the difference in color resolution. The images are for the customer’s reference only and Xize is not responsible for this. In addition, the dimensions of any products offered by Xize are approximate and there may still be differences in details between the colors, fabrics and designs of the products displayed on the Site and the products actually delivered by Xize to customers.
3.6. The Customer can visit the Shopping Bag page to view the selected product and the total price of the order.
3.7. Before submitting the relevant order (hereinafter referred to as the “Order”), the Customer is required to check the accuracy of the contents of the shopping bag and fill in the order truthfully according to the instructions on the Website.
3.8. The Customer must read the terms and conditions, including these Terms and Conditions, carefully before submitting the order and completing the payment. Once the customer has completed the payment by clicking on the “Pay Now” button, the ordering process is complete and the order is submitted directly to Xize.
3.9. After the payment is completed, the customer may not unilaterally change or modify the contents of the order, but can communicate with Xize to discuss the solution.
3.10. Once the Customer has completed the payment process for the Order, he or she may save or print these Terms and Conditions for future reference.
3.11. If the Customer submits the Order and does not complete the payment further, the Order will not be submitted to Xize for further processing; Orders will only be submitted to Xize for processing after the customer has submitted the order and the order payment process has been completed.
3.12. The Customer agrees and understands that Xize may collect, use, store and process the Customer’s personal information in accordance with Xize’s Privacy Policy posted on the Website. For more information, please see the Xize Privacy Policy posted on this website.
3.13. Customers can check the status of their order by going to the relevant order tracking and tracking page on the Website and contact Xize Customer Service for assistance.
Note: Customers are still required to contact Xize customer service representatives for the status of their orders for items ordered through Xize customer service representatives.
3.14. It is the Customer’s responsibility to guarantee the accuracy, completeness and authenticity of any information entered on the Website or otherwise provided to Xize at the time of ordering. In the event that Xize is unable to fulfill or complete the order due to various reasons such as the untrue, inaccurate or incomplete information provided by the Customer, the provision of the corresponding information to Xize without the consent of the third party, the inability of the delivery service provider to contact the recipient, the refusal of the recipient, or the failure of the delivery service provider to successfully deliver the information provided by the Customer, the Customer shall be solely responsible for all adverse consequences and losses arising therefrom, and Xize shall have the right to cancel the order in accordance with clause 4.4 without any liability. In addition, if Xize is unable to return the goods to the customer after the completion of the after-sales service due to the aforementioned reasons of the customer, the customer shall also be responsible for all adverse consequences and losses arising therefrom, including damage and loss of the goods.
3.15. The Customer may make a reservation on the Website for a number of Products that have not yet been commercially published, distributed and placed on the Market as “Products for Sale” by consulting with Xize Customer Service and confirming their consent above. The Customer understands and accepts that at the time the order is placed, these Products cannot be delivered immediately and that the estimated delivery time is subject to the time shown on the Product page or further notified by Xize (subject to clause 6.5).
3.16. The Customer agrees that if he/she orders pre-order or customised products, the Customer will be charged the total price of the ordered products in advance, even though such products cannot be delivered at the time of the Customer’s order.
Subject to these Terms and Conditions, and in particular subject to clause 6.5, if the Customer’s order involves one or more pre-sale or customised items in addition to the currently available Goods, Xize shall have the right to elect to have the Products in the order delivered separately or in conjunction with the Customer, unless the Customer contacts Xize separately.
3.17. Unless otherwise specified and stated, these Terms and Conditions shall apply equally to the sale of pre-sale and custom-made products on the Website.
4. Formation of the contract and confirmation of the order
4.1. The Customer shall carefully confirm the information of the Products to be purchased, including but not limited to the color, price, size, product details, delivery and return policies of the Products, etc., before submitting the Order, and if the Customer has any questions about the Product Information and Order Submission, etc., the Customer may refer to these Terms and Conditions further or contact Xize directly. The Customer shall ensure that all information submitted for the order has been carefully checked and that any errors in the input of the relevant information have been corrected prior to the submission of the order. The Customer understands that due to the instability of the Internet environment (e.g. due to uncertainties or contingencies such as power failures, equipment malfunctions, certain loopholes or logical errors left during the software development process), there may be reporting errors on the Website at the time of order submission, and therefore the contract is concluded only after the Customer has successfully submitted the order and completed the entire payment process.
Once the contract has been concluded, the order will be submitted to Xize for further processing and confirmation. If Xize notifies the Customer by SMS, e-mail or other means that Xize has received the Customer’s order information and has commenced processing, such notification does not mean that Xize has confirmed the order. Due to the instantaneous and concurrent nature of orders in the Internet environment, the Customer agrees that both the Customer and Xize have the right to unilaterally cancel the order before Xize further confirms the order; If the Customer wishes to cancel the order after Xize has confirmed the order, it must be agreed upon by contacting Xize or in accordance with Xize’s Return Policy (see Article 8 of these Terms and Conditions). In addition, due to system design and technical limitations, the customer’s order cannot be modified once submitted, if the customer intends to change or modify the order information, the customer shall cancel the order in accordance with the rules specified in this article and resubmit, or contact Xize to negotiate and resolve.
4.2. Xize will be deemed to have duly confirmed the Customer’s order when Xize sends the Customer a message via SMS, email or other means that Xize has confirmed the Order and stated the Order Number (the “Confirmation Message”). Customers can also check the status of their order through the relevant order tracking and tracking page on this website, and contact Xize Customer Service Center for assistance.
4.3. Further, as set out in 4.1, Xize may, at its discretion, cancel the Customer for any reason by not confirming the Customer’s order until it is confirmed by Xize, and the Customer understands and agrees that in such event Xize shall not be liable to the Customer. Xize’s decision not to confirm or cancel any order is binding on the Customer.
In the event that Xize does not confirm the order, Xize expects to notify the customer of the unconfirmed order by SMS, email or other means within 30 days of receipt of the order, but the foregoing date is only an estimate and the aforesaid notice for pre-sale items or customized products may be delayed accordingly depending on the specific delivery situation.
In the event that the order is not confirmed by Xize, the payment for the unconfirmed order will be refunded to the customer. If part of the order is not confirmed (e.g., due to the unavailability of part of the product, etc.), the customer will only be required to pay the price of the product that has been confirmed by Xize.
4.4. Notwithstanding the conclusion of the Contract, the Customer agrees that Xize may notify the Customer of the cancellation of the order by SMS, email or other means (hereinafter referred to as the “Cancellation Message”) in the event of any of the following circumstances, in which case Xize shall not be liable to the Customer:
- a) Xize and the customer agree to cancel the order through negotiation;
- b) a dispute exists or has occurred between Xize and the Customer, and the responsibility lies with the Customer;
- c) Whether in the past or present, the customer has violated or circumvented or failed to perform these Terms and Conditions, other relevant terms, conditions, policies or rules of the Website, or other circumstances that violate the principles of fairness and good faith;
- d) Xize has reason to suspect that the goods purchased by the customer are for non-consumer purposes, such as intended for distribution or resale, or for corporate or commercial purposes;
- e) the Customer is or is suspected of being involved in illegal or fraudulent activities;
- f) Xize has reason to suspect that any information provided by the Customer is untrue, inaccurate, incomplete, etc., or that Xize is unable to fulfill or complete the order due to various reasons such as the product delivery address and ordering information provided by the Customer does not match, inaccurate or incorrect, or the Customer provides the recipient’s information without the consent of the Customer, the Delivery Service Provider is unable to contact the Recipient, the Recipient refuses to receive the Customer, or the Delivery Service Provider is unable to successfully deliver the information provided by the Customer;
- g) the Customer orders one or more Goods in bulk and such Goods are shipped to the same Customer or delivery address, or the Customer purchases more than any quantity limit specified by Xize;
- h) Xize is unable to obtain payment of the price or payment authorization from the Customer;
- i) the goods may be subject to transport restrictions;
- j) In the process of purchasing goods, the customer has or is suspected of using behaviors or methods such as destroying or disrupting the operation order and system security of the Website;
- k) The product information displayed on this website is obviously wrong, unfair, or there are other major misunderstandings, such as incorrect product pricing, etc.;
- l) the order cannot be fulfilled or delivered due to force majeure or other circumstances beyond Xize’s control;
- m) Xize may cancel the order as stipulated by other laws and regulations or these Terms and Conditions.
The behaviors or methods mentioned above to disrupt or disrupt the operation order and system security of this website generally refer to behaviors including but not limited to the use of order farming software or other similar tools, repeated orders or rush to buy products, or the implementation of system disruption, cyber attacks, or batch registration, account registration with machines, and impersonation of clients with machines.
In the event of a cancellation of an order, if the Customer has paid for the Products purchased but has not yet been shipped, the Customer will receive a refund of the amount paid for the respective Products in respect of the cancelled Order in a timely manner; If the Xize has already been shipped, the customer may request a return and refund in accordance with clause 8 of these Terms and Conditions and, subject to clause 8, the customer will be promptly refunded the amount paid for the respective returned item in the order. In the event of any loss caused to Xize in the event of any loss caused to Xize in the event of the occurrence of subparagraph b)-m) of this Article, Xize may require the Customer to compensate accordingly.
4.5. In addition, in the event that the goods in the order are actually out of stock after the conclusion of the contract, Xize will contact the Customer as soon as possible regarding the out-of-stock to inform the Customer of the change in the delivery time, and the Customer understands that the delivery time will be delayed accordingly until the goods are delivered or the order is cancelled. In such a case, Customer may choose to continue to wait for the Products to arrive or to communicate with Xize regarding other possible alternatives, such as replacing the out-of-stock items in the order with other Products, in which case Customer agrees to waive any breach of contract or liability for claims of late delivery. If the delay in delivery is unacceptable to the Customer and an alternative cannot be agreed between the parties, Xize reserves the right to cancel the order and the amount of the cancelled order will be returned to the Customer in the original form without any liability to the Customer.
5.Prices and Payment Methods
5.1. The price of the goods sold on the Website is inclusive of VAT.

5.3. The total price shown on the “Shopping Bag” checkout page includes shipping costs.
In any case, Xize shall obtain the express consent of the customer when charging additional fees.
5.4. After the Customer has pressed the final order confirmation button (Buy Button), the Customer will be required to pay the total price shown on the settlement page as prompted. Xize reserves the right to change the prices of goods sold on the Site at any time without notice, subject to applicable legal provisions. Unless otherwise provided in these Terms and Conditions, the Customer’s purchase of the Goods shall be based on the price displayed on the checkout page at the time of successful order submission.
5.5. Payment can be made by PayPal, debit card, credit card, etc.
5.6. If the Website accepts the Customer’s credit/debit card for payment at the time of payment, the Customer acknowledges and warrants that he/she is the cardholder of the credit/debit card or has been legally authorized by the cardholder to use it, and that all information entered at the time of purchase shall be accurate, including but not limited to: credit/debit card number, expiration date, security code (if applicable).
Xize is not responsible for verifying that the Customer is the cardholder of the credit/debit card or that it has been legally authorized to use it by the relevant cardholder, or for verifying the accuracy of the information entered by the Customer at the time of purchase.
5.7. If the Customer uses any other means of payment (e.g. Alipay, WeChat Pay, etc.) other than credit/debit card, the Customer shall confirm and warrant that he/she is the legal owner of the Alipay account, WeChat account, etc., or has been legally authorized by the owner of the payment account to use it.
Xize is not responsible for verifying that the Customer is the owner of the Payment Account or has obtained legal authorization from the owner of the Payment Account.
5.8. The Customer undertakes that he/she is well aware of the risks of online payments. In order to prevent losses, the customer shall keep his/her account information, bank account information and any electronic payment account information in a safe place. If the customer logs in to use this website, the customer should log out securely. The Customer shall be solely responsible for any adverse consequences arising from the Customer’s violation of this Article, and Xize reserves the right to demand compensation from the Customer for any losses caused to Xize.
5.9. All credit/debit card holders and payment account owners are subject to verification checks and authorization from the card issuer or payment service provider. In the event of a refusal by the Customer’s card issuer or payment service provider to authorize the payment, Xize will not be able to confirm the Customer’s order, in which case Xize will not be liable for any delay or non-delivery and will not be obliged to inform the Customer of the reasons for the refusal.
5.10. Xize shall not be liable for any fees charged to the Customer by the Customer’s card issuer or payment service provider for processing the Customer’s credit/debit card payment or other payment method in accordance with the Customer’s order.
5.11. If the Customer’s credit/debit card or other payment method is not denominated in the currency indicated on the Website at the time of the Customer’s order, the final price may be charged in the actual settlement currency of the Customer’s credit/debit card or other payment method. This final price (and any additional fees charged) will be calculated and charged by Customer’s card issuer or payment service provider, and as such, Xize shall not be liable for any costs, fees, charges or other liabilities that Customer may incur or suffer as a result of the Customer’s card issuer or payment service provider charging Customer in a currency different from the currency displayed on the Website in which Customer made the purchase.
5.12. The Products purchased by the Customer will be shipped only after the full amount due has been duly paid and the order has been confirmed by Xize. If the customer is unable to pay the corresponding amount for any reason, the order process will be automatically terminated and the order will be cancelled.
5.13. Xize endeavours to ensure the accuracy of all pricing information on the Website. However, occasional errors, such as system instability or errors in uploading information, or similar oversights, can still lead to incorrect pricing. In the event of an obvious error in the price of the Goods, the Customer understands and agrees that Xize may contact the Customer and ask if the Customer wishes to purchase at the correct price, or cancel the order directly in accordance with clause 4.4 of these Terms and Conditions and notify the Customer. In any event, Xize is under no obligation to sell the Goods to the Customer at the price at which there is an error.
6.Delivery
6.1.The Products will be delivered to the address specified by the Customer in the Order. A signature is required at the time of delivery of the goods (the time of delivery of the goods), but Xize and its third-party delivery service providers are not responsible for verifying the identity of the recipient. If the product cannot be delivered due to untrue, inaccurate or incomplete information provided by the customer, due to the customer providing the corresponding information to Xize without the consent of the third party, the delivery service provider cannot contact the recipient, the recipient refuses to receive the product, or the delivery service provider is unable to successfully deliver the information provided by the customer, the customer shall take the initiative to contact Xize to solve the problem. If the delivery service appointed by Xize is unable to deliver the Products to the address specified by the Customer in the Order within five days of the first delivery attempt, Xize reserves the right to cancel the Order at any time in accordance with clause 4.4 and to notify the Customer without delay (subject to clause 3.14). In this case, Xize will refund the price of the corresponding product for the cancelled order to the customer, and Xize shall not be liable for this.
6.2.Xize will not process orders addressed to a P.O. Box or freight forwarder’s address, nor will it accept orders from customers whom Xize suspects to be non-natural persons. In this case, Xize reserves the right to cancel the order at any time in accordance with clause 4.4 and will notify the customer without delay (subject to clause 3.14), and Xize will refund the customer the price of the corresponding products for the cancelled order without any liability on the part of Xize.
6.3.The purchase and delivery of goods sold on the Website is limited to the territory specified in these Terms and Conditions (see clause 1.5). In accordance with the above, any order requiring the delivery of goods outside the confines of the region will be automatically rejected during the order processing process.
6.4.In the event that the delivery address provided on the Customer’s order is incorrect or incomplete, Xize shall not be liable for any delay or non-delivery of the Goods, and the resulting losses shall be borne by the Customer.
6.5. Except as otherwise provided in these Terms and Conditions or in the event of a force majeure event, Xize will arrange for the delivery of the Products as soon as practicable after the Customer’s order has been confirmed. However, any time provided by Xize in connection with the delivery and delivery of the Goods is Xize’s best estimate in general and does not represent a commitment by Xize to be fully realized, and the Customer understands and agrees that Xize shall not be liable for any loss or damage suffered by the Customer as a result of any reasonable or unavoidable delay.
Further, if Xize fails to deliver the order within the estimated time, Xize will notify the Customer of the change in the delivery time as soon as possible, and the Customer understands that the delivery time will be delayed accordingly until the delivery is delivered or the order is cancelled. In this case, the Customer may choose to continue waiting for the item to arrive or to communicate with Xize about other possible alternatives, such as replacing the out-of-stock item in the order with another item. If the delay is unacceptable to the Customer and the parties are unable to reach an alternative, Xize reserves the right to cancel the order, and Xize shall not be liable to the Customer. Under this clause, Customer agrees to waive any liability for breach of contract or liability for any delay in delivery by Xize.
6.5.Depending on the availability of the Goods, Xize may ship one order separately. In this case, Xize will notify the customer by SMS, e-mail or other means.
6.6.If the Customer’s purchase has been shipped, Xize will notify the Customer by SMS, email or other means, which will include a shipping tracking code.
6.7.In addition to delivery by delivery service, the Customer may also request to pick up the Products designated by Xize directly at the Store, which the Customer selects on the Website at the time of purchase. After Xize notifies the Customer by SMS, email or other means that the Products are available for collection, if the Customer does not collect the Products within 7 (seven) days, the Customer agrees that the Order may be cancelled by Xize in accordance with clause 4.4. In this case, the customer will be notified of the cancellation of the order and all amounts paid will be refunded to the customer, and Xize shall not be liable to the customer.
6.9. From the moment the Products are delivered in accordance with clause 6.1, the Customer shall bear the risk of loss or damage to the Products. In addition, in the event that the Products cannot be successfully delivered due to reasons attributable to the Customer (including, but not limited to, those listed in clause 4.4(f)), the Customer shall be at the Customer’s own risk of loss or damage to the Products from the date of the initial unsuccessful delivery, regardless of whether Xize thereafter elects to temporarily store the Products for the Customer.
On the other hand, in the event of damage or loss of the Product prior to delivery, the Customer agrees that Xize will cancel the Order in accordance with clause 4.4 and refund the price paid by the Customer in the same way it was made.
7.Product Conformity
7.1.At the time of delivery, the Customer must carefully check that the delivered Products, the packaging of the Products and any seals are intact and not wet, and must also read the accompanying Chinese labels, tags, instructions (if any), etc., to confirm that the delivered Products are consistent with the Products ordered and that there are no production defects or other conditions that do not match the description of the Customer at the time of purchase. In case of any problems, the Customer should promptly contact Xize Customer Service or request a return in accordance with clause 8. Customers are required to keep the original receipts and invoices (if any) as proof of purchase of goods or services.
7.2.Unless otherwise provided by applicable laws and regulations, the Customer may, within two years from the date of delivery of the Goods, apply for repair of the Products (except for perfumes, cosmetics, beachwear, underwear, made-to-measure goods and other products that Xize otherwise states that repairs cannot be carried out) in the event of a production defect in the purchased Products, provided that the Customer promptly notifies Xize within two (2) months from the date of discovery of the Product Productuality Defect. Xize reserves the right to determine whether the goods are repairable at its discretion based on actual use, wear and tear and damage.
7.3. In order to notify the existence of a defect in the Product and to request any of the remedies indicated above, the Customer may contact Xize in the manner described in Section 12 below.
8.Returns and Refunds
8.1.The Customer has the right to return the Products (except for beachwear, underwear, custom-made products, products that may affect personal safety or life and health after unpacking, products that are not suitable for return due to the nature of the Products, and other products otherwise stated by Xize) within 7 (seven) days from the date of receipt of the Products, provided that the Products to be returned meet the conditions of return described in Clauses 8.2 and 8.5, otherwise Xize reserves the right to refuse the return. If the customer intends to return the product before receiving it, Xize reserves the right to determine whether the customer can return the product immediately based on the actual delivery status of the product purchased by the customer.
8.2.In order to return a product, the Customer shall follow the procedures and requirements set out in the return instructions provided with the Product.
8.3. Provided that the Customer complies with the procedure set forth in the preceding paragraph, the delivery service provider appointed by Xize will receive the parcel containing the Goods and return it without charge to the Customer.
On the other hand, if the customer does not comply with the above procedure, the customer shall pay the cost of the return and be liable for the loss, theft, damage or delay in the delivery of the goods.
8.4. n any case, the Customer shall return the relevant Product within 7 (seven) days from the date of notification to Xize of the return.
8.5. The returned Merchandise must be in perfect and sellable condition, placed in its original packaging (e.g. box, cotton bag, etc.), with all relevant sales documents, accessories, instructions, labels, tags, gifts (if any), paper invoices (if any), certificates (if any), etc., and the Merchandise and the aforesaid accessories shall be free from any form of wear, absence or damage; Perfume and cosmetics products must be returned in their original packaging, especially the closure stickers and transparent plastic films (if any) covering perfume boxes and cosmetic boxes must remain sealed.
Xize will inspect the returned item to confirm that it is in perfect condition and eligible for return.
Xize reserves the right to refuse to return the Goods if they do not meet the conditions for return set out in clause 8.2 and the foregoing of this Article, or if the Products show signs of damage, deterioration, defacement, or if the condition shows that the Customer has used the Products for other purposes than the measures necessary to verify the nature and characteristics of the Goods.
In the event that Xize refuses to return the goods, Xize will send a specific notice to the customer, after which the amount paid by the customer will not be refunded, and the customer will also reserve the right to claim compensation for the damage caused to the customer.
8.6. Except as otherwise provided in these Terms and Conditions or as otherwise confirmed by both parties, if the Products returned by the Customer are in good condition and meet the conditions for return, Xize will refund the corresponding amount of the returned Products to the original payment method within 7 (7) days from the date of receipt of the Products returned by the Customer, and the specific payment time shall be subject to the Customer’s original payment channel.
